SCOOT AROUND LLC
PARTICIPANT AGREEMENT, RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, RULES OF USE, AND INDEMNIFICATION
This Agreement is entered into by the undersigned Participant (“Participant”) in consideration for being permitted to rent, operate, or otherwise use electric scooters and/or electric bicycles (“Equipment”) provided by Scoot Around LLC, including its owners, members, managers, officers, employees, contractors, volunteers, affiliates, insurers, successors, and assigns (collectively, “SA”).
By signing below or initiating a rental, Participant agrees as follows:
SECTION 1 – REQUIRED RULES OF OPERATION (CITY OF ASHLAND, KENTUCKY)
The City of Ashland, Kentucky permits the operation of shared scooters subject to compliance with local regulations. Participant agrees to follow all rules below:
- Scooters must be ridden in the street only.
- Riding on sidewalks is strictly prohibited.
- If cited or fined by law enforcement, Participant is solely responsible for all fines, penalties, or citations. SA is not responsible for municipal violations.
- When picking up or dropping off Equipment, Participant must walk (not ride) the scooter on sidewalks.
- Do not carry passengers. Double riding is strictly prohibited.
- Maintain a safe distance from other riders and vehicles.
- Obey all traffic laws, including stop signs and traffic signals.
- Do not block sidewalks, doorways, driveways, ramps, or building entrances.
- Do not park on lawns, landscaping, private property, or non-designated areas.
- Equipment must be returned to:
- The original pickup location; OR
- Another designated parking location approved within the mobile application.
Failure to comply may result in immediate termination of riding privileges and additional fees.
SECTION 2 – PARKING VIOLATIONS & COLLECTION FEES
Participant agrees to the following fees:
• $25 Collection Fee if Equipment is left outside the approved parking zone.
• $25 Collection Fee if Equipment is improperly parked.
If Equipment must be retrieved due to improper parking, Participant authorizes SA to charge the payment method on file.
SECTION 3 – MISUSE & DEPOSIT FORFEITURE
The following actions constitute misuse and are strictly prohibited:
- Jumping curbs, ramps, or stairs
- Performing stunts or wheelies
- Riding down steep grass hills or off-road areas
- Double riding (two people on one scooter)
- Reckless or abusive operation
If misuse occurs:
- The $40 deposit will be forfeited; AND
- Additional repair or damage charges may apply if Equipment is damaged.
Deposit forfeiture does not limit SA’s right to recover full repair or replacement costs.
SECTION 4 – ACKNOWLEDGMENT AND ASSUMPTION OF RISK
Participant understands that operating electric scooters or bicycles is a hazardous activity involving inherent and unforeseeable risks, including:
- Collisions with vehicles, pedestrians, or objects
- Roadway defects such as potholes, gravel, or uneven pavement
- Equipment malfunction or battery failure
- Loss of balance or control
- Negligence of third parties
- Weather-related hazards
- Serious bodily injury, paralysis, or death
Participant voluntarily assumes all risks, known and unknown, even if arising from the negligence of SA.
Participant affirms they are physically capable of safely operating the Equipment and agree to wear a properly fitted and secured certified helmet.
SECTION 5 – RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by Kentucky law, Participant releases, waives, discharges, and covenants not to sue SA for any claims arising from:
- Participation in scooter or e-bike activities
- Use or misuse of Equipment
- Alleged negligence of SA
This includes claims for:
- Personal injury
- Wrongful death
- Property damage
- Emotional distress
- Economic loss
Participant understands they are waiving substantial legal rights, including the right to sue.
SECTION 6 – INDEMNIFICATION AND DEFENSE
Participant agrees to defend, indemnify, and hold harmless SA from any claims, damages, liabilities, losses, or attorney’s fees arising from:
- Participant’s operation of Equipment
- Violations of traffic laws
- Injury or property damage caused to third parties
This obligation survives termination of this Agreement.
SECTION 7 – RESPONSIBILITY FOR DAMAGE, LOSS, OR THEFT
The account holder who initiates the rental is fully financially responsible for Equipment during the rental period.
Participant assumes responsibility for:
- Damage
- Theft
- Vandalism
- Loss
Participant authorizes SA to charge the payment method on file for:
- Repair costs
- Replacement value
- Administrative costs
- Recovery expenses
- Lost revenue during repair
Failure to pay may result in legal action in Boyd County, Kentucky. Participant agrees to pay all collection costs, attorney’s fees, and court costs.
SECTION 8 – MEDICAL RESPONSIBILITY
Participant certifies they have adequate insurance coverage. If not, Participant assumes full financial responsibility for medical expenses.
Participant authorizes emergency medical treatment if necessary and agrees to pay associated costs.
SECTION 9 – GOVERNING LAW AND VENUE
This Agreement shall be governed by the laws of the Commonwealth of Kentucky.
Any dispute shall be brought exclusively in the courts of Boyd County, Kentucky, and Participant consents to jurisdiction therein.
SECTION 10 – SEVERABILITY
If any provision is found unenforceable, the remaining provisions remain in effect.
SECTION 11 – CONTINUING EFFECT
This Agreement applies to the current rental and all future rentals unless revoked in writing and accepted by SA.
SECTION 12 – ACKNOWLEDGMENT
By signing below, Participant acknowledges:
- They have read this Agreement in full
- They understand its contents
- They voluntarily agree to be legally bound
- They are at least 18 years old (or parent/guardian signs below)

PARENT OR LEGAL GUARDIAN AGREEMENT
(Required for Participants Under 18 Years of Age)
I consent to the minor’s participation and:
Assume all risks on their behalf
Release SA from liability
Agree to indemnify and defend SA against any claims brought by or on behalf of the minor
